Abstract

In the case of Paradiso and Campanelli v. Italy, on January 27th 2015, the ECHR decided that a child born by surrogacy abroad and social parents enjoy protection of the right to family life.

Article 8 of the Convention protect their right to private and family life even though the surrogacy is forbidden in Italy, and without genetic link between child and parents, in force of a de facto family life, after a period of cohabitation of eight months. The Court concluded that Italy could not taking the child away from the foster parents, because the public order cannot violate the best interest of the child to remain with his foster family.

1. La decisione. Una coppia di coniugi italiani, constatata l’incapacità di generare anche attraverso tecniche di procreazione medicalmente assistita ed ottenuta la dichiarazione di idoneità all’adozione di minori, si rivolge ad una società russa perché, generato in vitro un embrione attraverso l’unione dei gameti dell’uomo con quelli di una donatrice anonima, lo impianti in una madre surrogata.

Alla nascita del bambino, il 27 febbraio 2011, in conformità con la legislazione nazionale, la puerpera sottoscrive una dichiarazione di rinuncia a qualsiasi pretesa nei suoi confronti, e viene formato un atto di nascita che indica come genitori i coniugi italiani. […]
